These Terms of Service ("Terms") are a binding agreement between you and Eventscue, operated as a sole proprietorship ("Eventscue", "we", "us"), governing your use of the Eventscue website and application (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eventscue researches an ideal-customer profile into a ranked list of target accounts, maps public B2B events those accounts appear at, and surfaces likely event participants for your review. Features are provided on an evolving basis; we may add, change, or remove functionality. Some features described in marketing or roadmap materials may not yet be available.
You agree not to:
The Service surfaces professional information about third parties from public sources for your review. You are solely responsible for how you use that information, including establishing your own lawful basis for, and complying with all laws governing, any outreach you send (for example GDPR/UK GDPR, PECR, CAN-SPAM, CASL, TCPA, and equivalent marketing and privacy rules). You will honour opt-out and deletion requests you receive and will not use the Service's outputs for unlawful, harassing, or discriminatory purposes.
We (and our licensors) own the Service, its software, and its design. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service while you maintain an account for your internal business purposes. You retain rights to the ICP inputs and content you submit, and grant us the licence needed to operate the Service and generate your results.
The Service is a paid subscription. There is no free plan. The plan, the price, and the length of the billing period are shown to you on the checkout screen before you are charged, and by completing checkout you authorise us to charge the payment method you provide.
Your subscription renews automatically. At the end of each billing period it renews for a further period of the same length, at the then-current price for your plan, and your payment method is charged automatically, until you cancel.
You can cancel at any time from Settings, which opens the billing portal of our payment provider. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. We do not refund partial billing periods except where the law requires it.
We will tell you before any price change takes effect, and you may cancel before it applies. If a payment fails, we may suspend access until the payment succeeds.
The Service and all data and outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to accuracy, completeness, or currency. Account fit scores, event mappings, and participant data are automated estimates derived from public sources and may be incomplete or incorrect; you must independently verify them before relying on them for any business, budget, or outreach decision. We do not guarantee any particular result, availability, or uptime.
To the maximum extent permitted by law, Eventscue and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of USD 100 or the amounts you paid us for the Service in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will indemnify and hold harmless Eventscue from claims and losses arising out of your use of the Service, your outreach, or your breach of these Terms or of applicable law.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, legal risk, or to protect the Service. Sections that by their nature should survive termination (including 4, 5, 7, 8, 9) survive.
These Terms are governed by the laws of the State of California, USA, and disputes will be resolved in the state and federal courts located in California, without regard to conflict-of-law rules.
We may update these Terms; we will revise the "Last updated" date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
